ROCK.COM PRIVACY POLICY

1.                   INTRODUCTION 

This Privacy Policy discloses the privacy practices of Rock.com and is incorporated into, and subject to the terms of, Rock.com’s Terms of Service located http://www.rock.com/TermsOfUse.htm (“TOS”).  All undefined capitalized terms used in this Privacy Policy shall have the meanings set forth in the TOS.  We care deeply about online privacy.  If you have any questions concerning this privacy policy, please email us at info@Rock.com. 

Rock.com provides several online services, including:

·         Web-based email accounts;

·         access to Internet audio transmissions;

·         music videos and text and video news;

·         an “Indie Corner” forum to upload and listen to music from independent artists;

·         an Internet sub-domain redirection service;

·         an online store for music-related merchandise (subject to the Addendum at the end of this Privacy Policy)

·         access to vendors of music merchandise and concert tickets;

·         access to Internet-based games;

·         a personal Web page hosting service;

·         a “Social Network” service that allows users to create unique personal profiles and communicate and share photographs and other information through chat, confidential messaging, online forums and other communications tools;

·         “Rock.com Concierge,” a service in which Rock.com acts as an intermediary assisting users in locating and purchasing concert tickets and related travel services and accommodations from third-party vendors; and

·         such other services and resources as Rock.com may provide in the future from time to time.

2.                   INFORMATION WE COLLECT

In almost all cases, we do not obtain any personally identifiable information about you unless you choose to reveal it.  You are not required to disclose any personally identifiable information to us, although many parts of our site may not be available to you unless you do so.

Rock.com collects information that users submit through user profiles, such as names, email addresses, age, personal interests, gender, education and occupation.  We also store music that users upload in the Indie Corner, personal Web page content that users upload to the hosting service, messages and communications generated through email accounts and the features of the Social Network service, and credit card and other order information submitted via the Concierge service.  In addition, Rock.com logs non-personally-identifiable information including profile information, aggregate user data, and browser type, from users and visitors to the site.  Rock.com also collects IP address information.  Although new techniques exist to obtain personally identifiable information using IP addresses, Rock.com does not use IP addresses for that purpose; provided, however, that Rock.com may log the IP address of a user’s computer and compare the online information provided in the Rock.com profile to try to prevent, eliminate, and investigate user fraud.

From time to time, Rock.com or a partner, may sponsor a promotion, sweepstakes or contest on Rock.com. Users may be asked to provide personal information including name, email address or home address or to answer questions in order to participate.  We may transfer personal information to certain ad partners from which you have explicitly requested to receive information.  In such case, it will be clear at the point of collection who is collecting the personal information and whose privacy statement will apply.  See the “Third Party Advertising” section below for more information. 

3.                   HOW WE USE AND DISCLOSE COLLECTED INFORMATION

General.  We may periodically view or access individual records for the purpose of resolving a problem or dispute, a support issue, a suspected violation of the TOS or as may be required by law.  Rock.com uses age information to limit access to Rock.com services to users 14 and older and, in some cases, to users who are adults.  For more information, see the section “Children” below and in the TOS.  We use email addresses to add users to other users’ Social Network circles, and to send updates, a newsletter or other notifications related to the service.  We also use demographic and other information contained in personal user profiles to serve targeted advertisements to users, including ads for special events or to promote other services on the Web site.

Usage Data.  Rock.com uses non-personally-identifiable information, including profile information, aggregate user data, and browser type, from users and visitors to the site, to manage the Web site, track usage and improve the Web site services.  User IP addresses are also recorded for security and monitoring purposes.

Web-Based Email.  Certain technical processing of e-mail messages and their content may be required to send and receive messages, conform to connecting networks’ technical requirements, conform to the limitations of the email service, or conform to other similar requirements.  Rock.com includes IP addresses in outgoing mail message headers, as specified by standard Internet protocol.  Rock.com reserves the right to send information notices and targeted marketing messages to any or all users’ Rock.com email addresses created through the Email Service without the right to opt out.  Furthermore, Rock.com may use the content of messages sent through the Email Service to generate targeted communications to users.  We do not otherwise use addressing information or the content of messages stored in your Web-based email account for any purpose.

Indie Corner.  We make music and other content you upload to the Indie Corner service available for registered users and the public to play, hear and view through the service.  We also use certain uploaded music, while such music is maintained in the Indie Corner, to promote Rock.com or a portion of the Service.  In addition, we use certain other content uploaded to the Indie Corner, such as pictures and band names, for promotional purposes, and we may continue to do so after users remove such content from the Indie Corner.  We do not use this content for any other purpose.

Personal Web Pages.  We make content you upload and store on your personal Web pages available for registered users and the public to access and view.  We do not use this content for any other purpose.

Social Network.  As part of the Social Network service, we automatically display a limited amount of personally identifiable user profile information, including members' pictures (if provided), age and location to other users and the public in order to facilitate user interaction in the Social Network community.  We encourage users not to reveal additional personally identifiable information on the public profile, such as addresses and telephone numbers, but users may provide any personal information they wish in private messages to other users.  Users’ email addresses are not available in the public profile; however, a user’s email address is revealed to another user if the user sends a message to the other user through the service.  The recipient’s email address is not available to the sender unless the recipient chooses to reply.   PLEASE BE ADVISED, HOWEVER, THAT ANYTIME YOU CHAT, POST MESSAGES, PHOTOS, VIDEOS OR MUSIC FILES, SET UP WEB PAGES, OR OTHERWISE PROVIDE CONTENT IN PUBLIC AREAS OF THE SOCIAL NETWORK, EACH OF THESE COMMUNICATIONS WILL BE LINKED TO YOUR ROCK.COM USERNAME.  This means that any other member using the Social Network may find and contact you through your username in response to any postings and messages you create in public areas.  To facilitate searching and finding friends and acquaintances on the service, Rock.com also allows users to search for other members based on personal information provided in numerous categories in the public profiles.

Rock.com Concierge.  Rock.com stores users’ credit card numbers, addresses, phone numbers and other order information submitted via the Concierge service as part of the users’ profiles so that Rock.com may offer expedited ordering to users who wish to make future purchases via the Concierge service.

4.                   SHARING AND DISCLOSURE OF INFORMATION ROCK.COM COLLECTS

Except as specifically described in this Privacy Policy or in circumstances in which you are expressly informed otherwise, as a matter of policy we do not sell, rent, share, trade, give away or otherwise disclose any of your personal information to third parties.. 

To present to members more targeted advertising, products and services, Rock.com may share with advertisers and other third parties:  (a) profile information; (b) aggregate usage information in a non-personally identifiable manner; (c) Rock.com email addresses; and (d) the content of messages sent through the Email Service. For more information see the "Third Party Advertising" section below.  In such situations, with the exception of Rock.com email addresses, we will never disclose information that will be used to identify you personally.

Finally, Rock.com may disclose personal information to a third party if we believe that disclosure is necessary:  (1) to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by Rock.com, whether or not a response is required by applicable law; (2) to enforce the Rock.com TOS or to protect our rights; or (3) to protect the safety of the public and users of the service.  Rock.com reserves the right to transfer personal information to a successor in interest that acquires rights to that information as a result of the sale of Rock.com or substantially all of its assets to that successor in interest.  For more information see the "Changes in Our Privacy Policy" section below.

5.                   INVITE A FRIEND

Rock.com uses a third party to provide the “Invite a Friend” service on the Web site.  If a user elects to use the Invite feature to invite a friend to our site, our third-party provider will ask the user for the friend's email address. The provider will automatically send the friend an email inviting him or her to join the site.  Rock.com does not store or use these email addresses for any purpose; accordingly, the collection and use of this information is entirely governed by the privacy policy of our third-party provider. 

6.                   LINKS AND MERCHANDISE SERVICES

This site may contain links to other Web sites. Please be aware that Rock.com is not responsible for the privacy practices of other Web sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information. This privacy statement applies solely to information collected by this Web site.

Furthermore, Rock.com provides access to merchandise services of several third-party vendors.  Such merchandise includes, without limitation, concert tickets, compact disks and audio equipment.  Please be aware that applicable third-party vendors operate and control these services, which in some cases may be co-branded with Rock.com.  Rock.com does not collect credit card or other financial information on the Rock.com Web site, and such third-party vendors, or other third parties, and not Rock.com, collect such financial information from users.  Accordingly, the privacy policies of such third parties will govern these services, and we encourage you to read the privacy statements associated with them.  This privacy statement will not apply to any information you supply to third-party vendors through such merchandise services.  Please note that, although Rock.com uses reasonable efforts to keep the list complete and current, vendors change frequently and you are encouraged to contact Rock.com if you wish to verify a particular provider or the location of its privacy policy.  Please see the Addendum to this Privacy Policy below for information regarding the collection, use and disclosure of information through the Rock.com online store accessible at store.rock.com.

Finally, as part of the Concierge service, Rock.com acts as an intermediary between users and third-party vendors providing tickets and related travel services.  In the course of ordering such tickets and services, users may provide credit card numbers and other personal information:  (a) directly to third-party vendors by means web pages operated by such vendors and co-branded with Rock.com; or (b) to Rock.com, which, in turn, provides such information to such vendors.  In either case, the privacy policies of such vendors will also govern these orders, and we encourage you to read these third-party privacy statements.

7.                   MESSAGE BOARDS, JOURNALS, CHAT ROOMS, WEBLOGS, CLASSIFIEDS AND OTHER PUBLIC FORUMS

Please keep in mind that whenever you voluntarily disclose personal information online to public areas such as message boards, journals, chat rooms, Weblogs or classified ads that information can be collected and used by others.  Among other things, other users may use such information to send you unsolicited communications.  PLEASE BE ADVISED THAT ANYTIME YOU CHAT, POST MESSAGES, PHOTOS, VIDEOS OR MUSIC FILES, SET UP WEB PAGES, OR OTHERWISE PROVIDE CONTENT IN PUBLIC AREAS OF THE SOCIAL NETWORK, EACH OF THESE COMMUNICATIONS WILL BE LINKED TO YOUR ROCK.COM USERNAME.  This means that any other member using the Social Network may find and contact you through your username in response to any postings and messages you create in public areas.

8.                   COOKIES AND OTHER TRACKING METHODS

Cookies are small pieces of information stored on your hard drive, not on our site.  We use cookies on our site for a number of reasons.  First, cookies all us to determine who is logged into the site so that we may deliver the content that is appropriate for, and target to, each user.  Second, cookies allow us to better understand how users use our site, which in turn helps us focus our resources on features that are most popular with our users.  You are always free to decline our cookies if your browser permits, but our site will not work properly in that case.

In addition to using cookies, in some circumstances we may track or collect information about your activities on our site by the numeric address assigned to the computer you are using (your IP address) or by the URLs that you come from or leave to.  This information is collected and shared with our partners in an aggregated, non-personally identifiable basis.  Please note that Rock.com allows third party advertisers that are presenting advertisements on some of our pages to set and access their cookies on your computer.  Advertisers' use of cookies is subject to their own privacy policies, not the Rock.com Privacy Policy.  For more information, see the section “Third Party Advertising” below. 

9.                   CHANGING OR REMOVING YOUR INFORMATION

Rock.com users may modify or remove any of their personal information at any time by logging into their account, accessing their profile and changing the information stored there.  In some cases, users may also control how other members and the service communicate with them.  Please be advised, however, that, to the extent that such information is also stored in other databases, we cannot always ensure that such corrections or deletions will immediately reach the other databases.  Also, you cannot manually change your IP address, although we may change it automatically.

10.                COMMUNICATIONS PREFERENCES AND OPTING OUT

Receipt of product/service announcements, administrative messages, special offers, newsletters, advertisements and other communications from Rock.com and its third-party providers is a condition of Rock.com membership, and you will not be able to opt out of receiving them.  To stop receiving any such communications, you must cease using all services on the Rock.com site.

11.                CHILDREN

Protecting the privacy of children is VERY important to us.  For that reason, we do not structure any part of our services to attract anyone under the age of 14.  Our system does not allow anyone who indicates they are under the age of 14 to join as a subscriber, and certain services on our site will not allow anyone who indicates they are under the age of 18 to use such services.  We will not knowingly collect or use any personal information from children that we know to be under the age of 14.  In addition, we will delete any information in our database that we know originates from a child under the age of 13.  Although advertisements promoting Rock.com on third-party Web sites may unintentionally  reach children under 14, Rock.com does not target advertising to children in that age range.  If you, as a parent or guardian, object to, or have concerns regarding, your child’s use of the Rock.com Web site, you may send Rock.com an email at info@rock.com requesting cancellation of your child’s account.  Upon receipt of such message and upon reasonable verification of your identity, Rock.com will terminate and delete the child’s account and all associated registration information and send you an email confirmation of such deletion; provided, however, that you should not assume that Rock.com has received and processed your initial cancellation request until you receive such email confirmation from Rock.com.  In addition, if parents believe their child (any age under 18) has accessed our system without their permission,  Rock.com encourages them to install parental control software on their computers permitting them to block their child’s access our Web site.    For more information on Rock.com’s policies and procedures regarding children, please see the section entitled “Children” in the TOS.  You may also visit http://www.ftc.gov/kidzprivacy for information from the Federal Trade Commission about protecting children’s privacy online.

12.                THIRD PARTY ADVERTISING

We use third-party advertising companies to serve ads when you visit our Web site.  Please note that this privacy statement covers the use of cookies and personal information by Rock.com and does not cover the use of cookies and personal information by any third-party advertisers.  Be aware that Rock.com is not responsible for the privacy practices of our advertising partners.  We encourage you to use prudence and caution in clicking through to Web sites for advertised products and services.  We also urge you to review carefully the advertising privacy policies of our advertising partners, to the extent they are accessible.   Please note that, although Rock.com uses reasonable efforts to keep the list located at the end of this Privacy Policy complete and current, service providers change frequently and you are encouraged to contact Rock.com if you wish to verify a particular provider or the location of its privacy policy.

Our Web advertising partners may set cookies.  These cookies allow the ad server to recognize your computer each time they send you an online advertisement.  In this way, ad servers may compile information (not including your name, address, email address or telephone number) about your visits to this and other Web sites, where you saw certain advertisements and which ads you clicked on.  This information allows an ad network to deliver targeted advertisements on this site and other sites about goods and services that our advertising partners believe will be of most interest to you.  Rock.com does not have access to or control of the cookies that may be placed by the third-party ad servers or ad networks.

In the course of providing online advertising services to Web sites and advertisers, certain of our advertising partners also use pixel tags (also known as clear GIFs or Web beacons).  A pixel tag is a line of code that is placed on a Web site by the Web site owner which enables our advertising partners to analyze advertising campaigns and the general usage patterns of visitors to Web sites.  In all such instances, the pixel tag is programmed to collect only anonymous information about your visit to a particular Web site.  This non-personally-identifiable information is sent to ad servers for processing.  Rock.com uses pixel tags to better understand the traffic patterns of visitors and to enable advertising partners to target ads to those visitors on other Web sites.  Rock.com or its advertising partners may use pixel tag information for reporting to advertisers about Web site traffic or to deliver targeted advertising to your browser.

Rock.com may provide users’ Rock.com email addresses to third-party marketers and advertisers and permit such third parties to send targeted marketing and advertisement communications to such email addresses without the right to opt out.  However, Rock.com will never provide any users’ alternate email address provided during registration for such purpose.  We may also provide to these third parties certain user profile information together with user’s Rock.com email addresses to permit such third parties to target communications to users with specific interests or other demographics.  Finally, Rock.com may permit third-party marketers and advertisers to use the content of messages sent through the Email Service to generate targeted advertising to users.

13.                SECURITY

Rock.com takes precautions to insure that user information is kept private.  We use reasonable security measures to protect user information stored within our database from loss, misuse, theft of alteration.  We restrict access to user information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff.  Moreover, Rock.com user accounts are secured by user-created passwords to prevent unauthorized access, maintain data accuracy and ensure appropriate use of user information.   Please note that no method of transmission over the Internet, or method of electronic storage is 100% secure, however.  Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time.  Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee the security of user information.  For any additional information about the security measures we use on Rock.com, please contact us a info@Rock.com. 

Please note that, as further described above, Rock.com provides several third-party vendors and providers with access to various types of user personal information solely for the purpose of permitting such vendors and providers to furnish services to users or the Rock.com site.  To our knowledge, such vendors and providers employ reasonable security measures to protect user information against unauthorized access or use.  Rock.com cannot monitor or control handling of user information by our vendors and providers, however, and their use of such information is accordingly governed by the privacy policies and terms of service of those third parties.

14.                CHANGES IN OUR PRIVACY POLICY

From time to time, we may make changes to this Privacy Policy.  If we make changes, we will post them on our site so users will always be aware of what information we collect, how we use it, and when we may disclose it.  You will be bound by any changes to the Privacy Policy when you use the site after those changes have been posted, so we encourage you to review this Privacy Policy frequently.

ADDENDUM TO PRIVACY POLICY

FOR ROCK.COM STORE

This Addendum supplements the Rock.com Privacy Policy, the terms of which are incorporated here by reference.

The Rock.com online store located at store.rock.com, through which users may browse and purchase various types of merchandise, is provided and operated by Rock.com Ventures LLC (“RCV”), an affiliate and licensee of Rock.com, Inc.  In connection with each order for merchandise, RCV requires users to provide certain order information, including names, billing addresses, shipping addresses, credit card information, telephone numbers, email addresses and age.

RCV uses users’ credit card numbers, addresses, phone numbers and other order information users submit to RCV to process and ship orders to such users.  It may also use email addresses to send periodic order information to users.  Finally, RCV may periodically use postal addresses, email addresses and other information obtained during the ordering process to mail or email store-related offers or marketing to users , and users will have no ability to opt out of receiving such offers or marketing].

Store.  Yahoo! hosts the store pages, ordering system, and order data and automatically collects order information, which Yahoo! stores for an indefinite period of time and shares with Rock.com.  If you accessed this store through Yahoo! Shopping, Yahoo! also automatically collects information about your shopping experience.  Please see the Yahoo! Privacy Policy for more information about how Yahoo! uses this information. 

The store site serves cookies to permit the shopping cart feature of the store to keep track of items placed in the cart during single shopping sessions and over  multiple sessions.  You are always free to decline RCV’s cookies if your browser permits, but the shopping cart feature of the site will not work properly in that case, and you may have difficulty submitting orders.

RCV sells products for purchase by adults, and the store site is not marketed to, or designed to attract, children.  If you are under 18, you may use the store and place orders for merchandise only with the involvement of a parent or guardian.
